  1. About us
    1. We are GoWork.ES Sp. z o.o.  (trading as GOWORK.UK), a company registered in Poland under company registration number KRS 0000907124. Our registered office is at Wirażowa 124 A, 02-145 Warsaw, Poland. Our VAT registration number is NIP 527-296-17-27, REGON 389239343.
    2. These terms and conditions of use (“Terms”) constitute a legally binding contract between you (‘you’ or ‘your’), and GoWork.ES Sp. z o.o. Serwis Pracy Sp. z o. o. (‘we’, ‘us’ or ‘our’) and explain how you may use this Website and any of its content, general conditions, types and scope of provided services.
    3. These Terms together with the applicable law in the United Kingdom set out your rights and obligations and our rights, obligations and liability.
    4. We provide Services by electronic means in accordance with the Terms and applicable law.
    5. You should read these Terms carefully before using the Website. By using the Website or otherwise indicating your consent, you agree to be bound by these Terms. If you do not agree with any of these Terms, you should stop using the Website immediately. These Terms apply to any parts of the Website, its functionality and content provided to you free of charge for information purposes only.
  2. About our Terms
    1. The main purpose of the Website is to enable you to establish and maintain contacts with other users in order to exchange information, comments and views, use information and materials posted on the Website.
    2. The use of the Website may only take place on the terms and to the extent set out in these Terms.
    3. All intellectual property rights in the Website and in any materials and information submitted to or accessible from the Website, in particular texts, navigation solutions, selection and layout of the presented content, logos, verbal and graphic, interactive services, audiovisual materials, compilation of materials, photos, surveys, forms, templates and studies is our property. This also applies to any material provided by us that is available to users electronically, in particular by means of an e-mail. Intellectual property rights that are property of other manufacturers, distributors and service providers and are subject to legal protection are excluded from the above.
    4. We reserves all our intellectual property rights (including, but not limited to, all copyright, trade marks, domain names, design rights, database rights, patents and all other intellectual property rights of any kind) whether registered or unregistered anywhere in the world. This means, for example, that we remain the owner of them and are free to use them as we see fit.
    5. Nothing in these Terms grants you any legal rights on the Website or its content other than as necessary for you to access it. You agree not to adjust, try to circumvent or delete any notices contained on the Website (including any intellectual property notices) and in particular, in any digital rights or other security technology embedded or contained within the Website. Modifying, copying, distributing, transferring, displaying, sending, reprinting, sublicensing, creating aggregates works with the materials referred to above, as well as the return and sale of these materials is not acceptable, unless on the basis of appropriate authorization granted by us.
    6. We operate on the basis of "notification and removal" procedure of the content of the Website. If you have any objections or complaints about the content of the Website, including users’ messages posted on the Website or the Services, or if you believe that materials or content posted on the Website or the Services violate your rights copyright, please contact us immediately. To do so, please follow the steps below according to our complaint procedure. We will reply to legitimate and substantiated complaints, taking all appropriate steps to remove illegal content within a reasonable period of time.
    7. We reserve the right to post on the Website or the Services advertising content regarding the services and goods offered by third party services in the forms acceptable on the Internet.
    8. To use the services of the Website, it is necessary to have a device allowing the use of Internet and the Internet browser enabling the display of websites.
    9. The Website enables the collection of information about users' activities on pages of the Website to third-party systems for statistical purposes (e.g. Google Analytics, Gemius Traffic), advertising (e.g. Google AdSense) as well as for the purpose of conducting an advertising campaign targeted at users (targeting advertisements to remarketing lists in Google Adwords).
    10. We reserves the right to store "cookies" on your devices in order to facilitate your navigation and proper functioning of the Websites. The cookie policy is available below.
  3. Using the Website
    1. The use of the Website's resources may only be made for your own purposes. It is not allowed to use the resources and functions of the Website in the purpose of carrying out a commercial activity or in breach of our interest.
    2. You agree that you are solely responsible for all costs and expenses you may incur in relation to your use of the Website.
    3. We make no promise that the Website is appropriate or available for use in locations outside of the UK. If you choose to access the Website from locations outside the UK, you acknowledge you do so at your own initiative and are responsible for compliance with local laws where they apply.
    4. To access certain features of the Services, you must create an Account. When creating the account, the information you provide must be complete and accurate. You are solely responsible for actions performed in your Account, such as interactive services and the communication with other people or users. We are not obliged to permit anyone to register with the Website and we may refuse, terminate or suspend registration to anyone at any time. You are responsible for making sure that your password and any other account details are kept secure and confidential. If we have a reason to believe there is likely to be a breach of security or misuse of the Website through your Account or the use of your password, we may notify you and require you to change your password, or we may suspend or terminate your account.
    5. As a condition of your use of the Website, you agree not to use the Website, the Forum or any other interactive services:
      • for any purpose that is unlawful under any applicable law or prohibited by this Terms or the principles of social coexistence (including discriminatory, defamatory, vulgar or libellous material based on religion, race, ethnicity) or promoting violence or persuading to commit a crime;
      • to commit any act of fraud;
      • to distribute viruses or malware or other similar harmful software code;
      • for purposes of promoting unsolicited advertising or sending spam;
      • to simulate communications from us or another service or entity in order to collect identity information, authentication credentials, or other information (‘phishing’);
      • in any manner that disrupts the operation of the Website or business or the website or business of any other entity;
      • in any manner that harms minors;
      • to promote any unlawful activity;
      • to represent or suggest that we endorse any other business, product or service unless we have separately agreed to do so in writing;
      • to gain unauthorised access to or use of computers, data, systems, accounts or networks. It is unacceptable to create accounts of non-existent users and transfer personal data of other people as your own personal data, using other users' accounts or sharing your own Account with other people;
      • to attempt to circumvent password or user authentication methods;
      • to post any material which is recognised as morally reprehensible, socially inappropriate or violating personal rights. It is unacceptable to use someone else’s image in an unauthorized way, violate good manners or the principles of etiquette and perform any other activities that would expose the Website to legal liability or could harm any user; or
      • to infringe copyrights and rights arising from registration of inventions, patents, trademarks, designs utility and industrial of other people.
    6. It is forbidden to post on the Website or disseminate through the Website:
      • copyrighted software without licensing agreements or any authorizations,
      • software intended for unauthorized destruction, changing, deleting, damaging or obstructing access to data information technology, significantly disrupting or preventing it as well as processing, collection and transmission of such data, disrupting the operation of ICT systems and networks,
      • computer passwords, access codes or other data enabling unauthorized access to information stored on a computer system or ICT system.
    7. You place content on the Forum at your own risk. We have the right to (i) remove or moderate the content that deems illegal or inconsistent with the Terms and (ii) block participation in the Forum in relation to users violating any of the provisions of 3.5 and 3.6.
    8. We are not responsible or accept any liability for content posted, stored or transmitted to the Website by you (if the content is yours) or by third parties (for any content) or for any loss or damage of such content. Any submission you make to the Website or interactive services and any other communication to users of our Website by you must conform to standards of accuracy, decency and lawfulness, which shall be applied in our discretion, acting reasonably. In particular, any submission or communication by you must be: your own original work and lawfully submitted; factually accurate or your own genuinely held belief; provided with the necessary consent of any third party; not defamatory or likely to give rise to an allegation of defamation; not offensive, obscene, sexually explicit, discriminatory or deceptive; and unlikely to cause offence, embarrassment or annoyance to others.
    9. We are not responsible for any errors, defamation, slander, insults, omissions, falsehood, indecency or pornography. We, as a provider of interactive services, do not bear responsibility and are not liable for any statements, representations or content provided by our users (including you in relation to your content) on the Website or any other Forum. Although we have no obligation to view, edit or monitor any content that is published or distributed on the Website and we reserve the right, at its sole discretion, to delete, view, translate or edit (without notice) any content posted or stored on the Website at any time and for any reason (or ask third parties to take such action on their behalf). You are solely responsible for backing up your content posted or stored on the Services, and for its restoration at your own risk.
  4. Services
    1. We provide paid services (“Employer Account”) on the basis of an individual price offer and free services. The use of content and functionality of the Website and users’ Accounts are free of charge. Paid services are performed by us at your request and subject to a contract with us.
    2. Access to paid and free services is granted upon accessing the Website (after or without registration) in the form of:
      • posting your own data to get in touch with others users,
      • using search mechanisms to search other users,
      • recommending websites selected by you to other users and websites,
      • receiving and sending messages,
      • posting content on the Website, including comments on the Blog and the Forum,
      • receiving notification of new opinions about the employer,
      • adding an opinion about an employer and establishing a new, free employer profile by adding an employer review not yet in the database (in this case, the person adding it has no control over profile).
    3. Using the services described in paragraph [4.1] is possible after we are provided with your e-mail address.
    4. You have access to all your opinions and you will receive notifications of new comments that have appeared in companies selected by you (notifications in your Account or on e-mail, depending on the option that you choose during registration / account configuration).
    5. You can edit opinions and delete them by contacting our support department - [email protected]. We may show that your review was edited or removed.
    6. You can unsubscribe at any time. However, it does mean that your comments are deleted. If you want to remove your comments after unsubscribing, you must contact customer service.
    7. It is possible to use the paid services provided by us after registration by signing a contract for the provision of an additional service and making the payment of the required amount for the provision of a paid service.
    8. We will provide detailed conditions, including the type, scope and price of the paid service, in the Service Specification.
    9. As part of the paid services, we offer solutions aimed at improving an employer’s image. Our offer is available after contacting our Customer Service via [email protected]
    10. The Website may contain hyperlinks or references to third party advertising and websites other than the Website. Any such hyperlinks or references are provided for your convenience only. We have no control over third party advertising or websites and accept no legal responsibility for any content, material or information contained in them. The display of any hyperlink and reference to any third party advertising or website does not mean that we endorse that third party’s website, products or services. Your use of a third party site may be governed by the terms and conditions of that third-party site and is at your own risk.
  5. Termination
    1. This contract for the provision of Services by electronic means may be terminated by either party.
    2. You have the right to terminate the contract for free electronic services by removing your Account. If the use of the services does not require the creation of an Account, termination of the contract is made by ceasing to use the Services provided by us.
    3. Contract termination provisions for paid services are specified by us each time in the Service Specification.
    4. We have the right to terminate the contract for the provision of the Services by electronic means, including deleting the Account in the following cases:
    5. use in inappropriate manner or in breach of these Terms,
    6. we have reasonable grounds to believe that the name of the Account is (i) illegal or against good customs or (ii) violates the rights of third parties or (iii) is against our interests,
    7. posting by you of content no compliant with applicable law.
    8. We will inform you about the termination of the contract within 3 days from deleting the Account.
    9. We reserve the right to refuse to provide the Services to you, (including deletion of your Account), if a new Account has been created after deletion of an Account due to violations of the Terms.
  6. Our Liability
    1. If we breach these Terms or is negligent, we are liable to you for foreseeable loss or damage that you suffer as a result. By ‘foreseeable’ we mean that, at the time these Terms were formed, it was either clear that such loss or damage would occur or you and we both knew that it might reasonably occur, as a result of something we did (or failed to do). We are not liable to you for any loss or damage that was not foreseeable, any loss or damage not caused by our breach or negligence, or any business loss or damage.
    2. Nothing in these Terms excludes or limits our liability for wilful misconduct or gross negligence, our liability for a negligent breach of material contractual duties and for any matter that cannot be excluded or limited under applicable law.
    3. To the fullest extent permitted by law, our liability is excluded for
    4. any damage caused to third parties as a result of your use of the Services in a manner inconsistent with the Terms or applicable laws;
    5. the content and materials provided by you through the Services, infringing applicable law or any rights of third parties. You agree that you shall indemnify and compensate us for any loss, liability, claim, damage or expense (including reasonable legal fees and court fees) suffered by us as a result of any third party claim against us in connection with any ads posted to the Website under your account,
    6. the use of materials posted by you on the Website which were not provided by us,
    7. loss of data by you caused by external factors or other circumstances beyond our control,
    8. unavailability of the Website for reasons beyond our reasonable control,
    9. interruptions in access to the Website, including those preventing the use of the Services, caused by Website’s maintenance or failure fixing, equipment or software testing
    10. damages suffered by you, caused by incorrect information or reading of information,
    11. technical problems relating to the use of the Website, beyond our reasonable control including natural disasters, emergencies (natural and man-made), and acts of God or any other exceptional event or circumstance over which we have no control.
    12. We do not guarantee the accuracy or completeness of the information, text, graphics, links or other details contained in the material or content on the Website. Any reliance that you may place on the information on the Website is at on your own risk. We cannot promise that the Website will be fit or suitable for any purpose. The Information on the Website does not constitute technical, financial or legal advice or any other type of advice and should not be relied on for any purposes. You should always use your own independent judgment when using the Website and the information provided on the Website.
    13. We shall not be liable for any indirect, special, incidental or consequential damages, losses or expenses (including, but not limited to, loss of good will, loss of business, loss of profits, loss of work, loss of data, computer malfunctions) or indicative or punitive damages that may directly or indirectly arise from (i) use of any information available through the Services or on the Website, (ii) any kind business interruption, (iii) accessing, viewing or using the Services, (iv) delay or inability to access or use Services, (v) loss of any personal or financial data stored on the Website or the Account, (vi) errors or omissions in content. Information on the Website is subject to change without prior notice, and it does not create any future liability for us.
  7. Data Protection and Privacy
    1. We will only use any personal information that we may collect about you in accordance with our privacy policy. Our privacy policy is an important part of these Terms and it is important that you read it.   8. Complaints
    1. We will try to resolve any disputes with you quickly and efficiently. Any complaints about the provision of Services, as well as the Website’s activities should be reported to the address [email protected] or using the application form available at the Website - https://gowork.uk/contact.
    2. A properly submitted complaint should contain at least the following:
    3. the entity submitting the complaint (name, surname or company, e-mail address) and, if applicable a power of attorney.
    4. the subject of the complaint,
    5. circumstances justifying the complaint.
    6. Complaints will be considered within 21 days from the date of the receipt. If it is necessary to supplement the complaint, the deadline to consider the complaint runs from the date of delivery of the last required document or the last information requested (also by means of remote communication).
    7. We will consider complaints based on these Terms.
    8. Our decisions regarding the complaint will be made in writing.
    9. The right to pursue claims arising out of services provided by us by electronic means shall be made once the complaint procedure has been completed.
  9. Amendments to the Terms
    1. We reserve the right to change the terms and conditions of the use of the Website or the Services by way of changing the Terms or introducing new terms.
    2. We may modify, suspend or at any time discontinue any aspect of the Services, including the availability of any feature, database or content. We may impose restrictions or otherwise limit access to the Services, in whole or in part, without notices or obligations, for technical reasons or security to prevent unauthorized access, loss or destruction of data, or if we consider that any provision of these Terms, applicable law or regulations have been violated and this means that the provision of the Services must be discontinued.
    3. We reserve the right to vary these Terms from time to time. Our updated Terms will be displayed on the Website 30 days prior to such change and by continuing to use and access the Website following such changes, you agree to be bound by any variation made by us. It is your responsibility to check these Terms from time to time to verify such variations.
    4. We may terminate this agreement at any time without notice if we believe, in good faith, that any of the provisions have been violated or we have reasonable grounds that such termination is justified in order to preserve the rights of us or other users of the Service. As a result, we will stop providing these Services.
  10. Final Provisions
    1. The rights and obligations of us are specified solely in these Terms and applicable law.
    2. The Terms come into force on the day of the publication on the website https://gowork.uk and from that day, it will apply to contracts concluded with us.
    3. The provisions of the Terms do not infringe consumers’ rights under applicable law that apply irrespective of the provisions of these Terms
    4. We reserve the right to assign in whole or in part all our rights and obligations related to the Website, without the consent of any users.
    5. If at any time any provision of these Terms is or becomes illegal, invalid, or incapable of being applied in any respect under the law of any jurisdiction, all other provisions of the Terms will remain legal, valid and capable of being applied under the law of that jurisdiction as well as under any other applicable law.
    6. Any appendices to the Terms constitute an integral part thereof.
    7. No one other than us or you have any right to enforce any of these Terms.
    8. These Terms and any non-contractual obligations arising out of or in connection with the Terms are governed by, and interpreted in accordance with, the laws of England. Any disputes will be subject to the non-exclusive jurisdiction of the courts of Poland. The above does not applies to the extent that the laws of your country of residence requires another law or jurisdiction. If you are using the Services as a consumer and not as a business or the company's legal representative, you have the right to make a claim against us in the courts of your country of residence. This clause will apply to its fullest extent as permitted by the law of your country of residence. Nothing in this clause will limit our right to commence proceedings against you in relation to any dispute or claim in any jurisdiction that we consider appropriate, nor will the taking of proceedings in one or more jurisdictions preclude us from taking proceedings in any other jurisdiction, whether concurrently or not, if and to the extent permitted by applicable law.
